Compliance requirements
The bidder must be excluded from the procurement procedure if any of the grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator or another person authorised to represent it: conviction for participation in a criminal organisation, breach of duty of loyalty, corruption, fraud, terrorist offences or related incitement/assistance/attempt, money laundering or terrorist financing; enabling illegal employment of a foreign national or violating the conditions for employing a foreign national in Estonia; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears; or a breach of an international sanction or a sanction of the Government of the Republic.
The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment, if this is required by the laws of that country. If registration is mandatory, a copy of proof of registration must be submitted; an Estonian bidder does not need to submit a register extract.
The bidder and/or its subcontractor must have performed at least one contract similar to the subject of the tender within the 36 months preceding the start of the procurement, related to the installation of fire alarm systems. Form 2, the list of contracts, must be submitted with information on the contract value, dates and the other contracting parties.
The bidder and/or its subcontractor must have qualified responsible persons for the works: a security systems technician with at least vocational certificate “Security Systems Technician, level 4” and competence in “installation and maintenance of fire alarm systems”, or a Honeywell Esser FlexES installation and commissioning competence certificate; a responsible security systems specialist with at least vocational certificate “Responsible Security Systems Specialist, level 5” with the same competence; a person managing electrical works with at least a class B competence certificate; and a security systems designer with at least vocational certificate “Security Systems Designer, level 6” and competence in “design of fire alarm systems”. Form 3, the list of responsible specialists, and copies of documents proving competence must be submitted. A foreign bidder that does not have the responsible-person documents issued in Estonia must submit copies of the documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
