Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurists or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour, human trafficking, or any other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The ESPD also asks whether this information is electronically available.
Qualification criteria and exclusion grounds
The bidder must submit the ESPD and meet the qualification and suitability conditions required therein. The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. According to the compliance conditions, the bidder must confirm that the bid complies with the tender documents, that any equivalence has been explained and supporting evidence has been attached where necessary, and that all mandatory forms have been submitted. The mandatory forms are Form 1, Form 2 and Form 3 depending on the lots in which the bidder participates, and Form 4, the list of transport vehicles, is mandatory for all bidders. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bid must be unconditional and the price must be submitted in the required structure.
