Summary

The tender covers employment-law advice and labour-management services for the Biomedical Research Foundation of San Carlos Clinical Hospital as a single lot. The contractor will provide ongoing employment-law advice and represent the Foundation before public authorities, in labour disputes and before social courts at all levels. Monthly labour-management work includes drafting and administering employment contracts, payroll, social-security contributions, tax-withholding declarations, personnel reports, responding to employee enquiries and preparing personnel-cost documentation for research projects. The services also cover collective-agreement and employment-relations matters, and representation of the Foundation in employer committees and commissions. The contract runs for one year and may be extended up to four times for one year each, for a maximum term of five years. The annual budget ceiling is €96,000 excluding VAT, and the maximum unit price per payslip is €18 excluding VAT. Payment is for services actually delivered, and the Foundation is not required to use the entire budget. Offers are assessed on price (30 points), the quality of the service organization, methodology and treatment of key labour-management issues (45 points), and the team (25 points). At least 22.5 out of 45 qualitative points are required before the price offer is assessed. The bidder must demonstrate annual turnover of at least €144,000 in the relevant field and, in general, provide at least five certificates of satisfactory similar services performed during the last three years. The team must include at least three people with a relevant degree in Law, Labour Relations or Social Graduate studies: the general advice lead and at least two further specialists must each have at least five years of relevant experience gained during the last seven years. Offers must be submitted electronically, and the successful bidder must provide a final guarantee equal to 5% of the contract award amount excluding VAT.
