Compliance requirements
The bidder must confirm that neither it nor its administrative, management or supervisory board members, procurists, or other persons authorised to represent, control or make decisions on behalf of the company are subject to the exclusion grounds set out in Section 95(1), points 1–5 of the Estonian Public Procurement Act. These grounds include, among other things, convictions for participation in a criminal organisation, breach of the duty of integrity, corruption, fraud, terrorism or terrorist financing, money laundering, enabling illegal employment, breaches of the conditions for employing a foreign national in Estonia, illegal use of child labour, or trafficking in human beings. The bidder must also have no outstanding national taxes, payments or environmental charges, or tax or social security contribution debts, and entering into the contract must not breach an international or Government of the Republic sanction.
Qualification criteria and exclusion grounds
The bidder or its subcontractor must have a qualified person responsible for electrical works for the performance of the contract. This person must hold a professional certificate as an electrical engineer at least at level 7, or Class A competence that is equivalent or higher. The bidder must submit copies of documents proving the responsible person’s qualifications and competence. A foreign bidder that does not have documents issued under the regulations applicable in Estonia must submit the corresponding documents issued under the laws of its country of establishment and confirm that it will provide, within one month after signing the contract, confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding that person’s qualifications and competence. The tender must include an estimated delivery and works schedule in weeks from the conclusion of the contract, as well as a short description or product sheet for the offered vacuum circuit-breaker package. The tender price must be submitted according to the structure specified in the pricing sheet, and the tender must comply with all tender document requirements; conditional tenders are not permitted. In the case of a joint tender, a power of attorney appointing an authorised representative must be submitted. The machine-readable notice does not specify the detailed award criteria or any financial capacity or previous experience requirements; these must be checked in the tender documents.
