Compliance requirements

The bidder must confirm that neither the bidder nor its representatives or members of its management or supervisory bodies is subject to the exclusion grounds set out in the tender. These grounds include participation in a criminal organisation, corruption, fraud, terrorist offences or terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of trafficking in human beings. The bidder must also have no outstanding taxes or social security contributions, no relevant breach concerning the employment of unlawfully staying foreign nationals in Estonia, and no situation in which awarding the contract would breach an international or Estonian sanction. Where applicable, the bidder must provide information and evidence concerning convictions, breaches of obligations, exclusion periods, and measures taken to restore reliability. If tax or social security contribution arrears exist, the bidder must describe how the obligations have been settled or covered by a binding payment arrangement, including interest and late-payment charges.

Qualification criteria and exclusion grounds

Within the 36 months preceding the start of the procurement, the bidder must have at least one relevant experience: publishing at least one periodical publication that is issued regularly and delivered to homes on subscription, or completing a contract for publishing a local government newsletter. The bidder must provide a list of references in the ESPD, including the performance period and information about the other contracting parties. The contract may have started before the 36-month reference period and does not have to have been completed during that period. The bidder must also be capable of carrying out or arranging, through subcontractors, the home delivery of the printed municipal newsletter. If subcontractors are used, the bidder must provide their names and contact details together with an overview of the service. The tender must comply with the procurement documents; conditional tenders are not permitted; and the tender price must be submitted in the structure specified by the contracting authority. In the case of a joint tender, a power of attorney from the joint tenderers must be attached. The bidder must identify and justify any trade secrets; the tender price and numerical figures relating to evaluation may not be classified as trade secrets.
