Compliance requirements
The tenderer must confirm that neither it nor its management, administrative or supervisory body members or representatives have been finally convicted within the last five years of offences including participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, trafficking in human beings or the use of child labour. Compliance with tax and social security payment obligations is also checked; a tenderer with tax or social security arrears may be excluded.
The exclusion grounds also cover breaches of environmental, social and labour-law obligations; bankruptcy, liquidation or another insolvency situation; assets being administered by a liquidator or court; suspended business activity; serious professional misconduct; anti-competitive agreements; an unresolved conflict of interest; and a significant or repeated breach of a previous public contract resulting in early termination, damages, a price reduction or a contractual penalty. A tenderer may also be excluded for submitting false information, failing to provide required information or documents, or improperly influencing the contracting authority’s decision-making process.
The tenderer must also confirm that no national exclusion ground applies, including enabling an unlawfully staying foreign national to work, violating international sanctions or having been convicted of tax-related offences. Where applicable, the tenderer may submit evidence of remedial measures taken to restore its reliability. The exact evidence and verification procedure must be checked in the tender documents.
Qualification criteria and exclusion grounds
Within the 36 months preceding the commencement of the procurement, the tenderer must have properly completed at least 1 similar contract for the maintenance and repair of garage doors, lifting doors, automatic doors, barriers or automatic gates. The reference contract must have a value of at least EUR 20,000 excluding VAT. If the contract is still in progress on the bid submission deadline, the value of work actually completed under that contract must be at least EUR 20,000 excluding VAT. The tenderer must provide a description of the contract, its value, performance period, client details, the tenderer’s area of responsibility and the required contact and verification information.
The bid must include Form 1, the price schedule, as well as the details and competence description of the specialists who will provide the service in accordance with the technical specification. Those specialists must be involved in contract performance. The bid must comply with all tender document requirements; conditional bids are not permitted. The bid must be submitted or signed by the tenderer’s statutory or authorised representative. If submitted by an authorised representative, a power of attorney must be included; in the case of a joint bid, a power of attorney for the joint tenderers must be provided.
The tenderer must confirm that it will not use subcontractors or suppliers covered by sanctions, Russian persons or entities, or entities owned or controlled by them or acting on their instructions, for more than 10% of the contract value. It must also confirm compliance with international sanctions, conformity of the bid and, where relevant, equivalence supported by appropriate evidence. Any trade secret must be identified and justified; the bid price and numerical figures corresponding to the award criteria may not be designated as trade secrets.
