Compliance requirements

The bidder must confirm that neither it, its management or supervisory board members, nor persons authorised to represent or control it have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also have no breach of tax or social security payment obligations. The notice states a threshold of EUR 0 for tax and social security debts, while the tax authority does not issue a debt certificate for a debt below EUR 100 or where payment has been deferred. The bidder must not have entered into an agreement with creditors, be bankrupt, in liquidation or insolvency proceedings, have assets administered by a liquidator or court, have suspended business activities, or have committed a serious breach of professional conduct. There must also be no anti-competitive agreements, unresolved conflict of interest, improper involvement in preparing the procurement, serious breach of previous public contracts, or situation involving false information or failure to provide required documents. The confirmations also cover compliance with environmental, social and labour-law obligations, international sanctions, rules concerning the employment of unlawfully staying foreign nationals, the absence of tax offences, and the bidder’s legal right to participate in the tender. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. Subcontractors or suppliers falling within the specified Russian ownership or connection categories may not account for more than 10% of the contract value. Where subcontracting is used, the bidder must submit information on each subcontractor and a signed confirmation that no exclusion grounds apply; the contracting authority will check first-tier subcontractors and may require a non-compliant subcontractor to be replaced. The bidder must also confirm that no corrupt acts have been committed in the procurement procedure. Any detailed evidence requirements and the availability of self-cleaning must be checked in the tender documents where necessary.

Qualification criteria and exclusion grounds

Qualification is based on experience in selling similar goods during the 36 months preceding the start of the procurement. For each lot, the bidder must provide a list of at least one suitable sales contract, including its value, contract dates and information about the other contracting party, including the client contact person’s name, email address and telephone number, and the procurement reference number where applicable. - Lot 1 “Furniture and furnishings”: at least one similar furniture and furnishing sales contract including delivery and installation, with a value of at least EUR 100,000 excluding VAT. - Lot 2 “Textiles”: at least one similar textile sales contract with a value of at least EUR 2,000 excluding VAT. - Lot 3 “Equipment”: at least one similar equipment sales contract with a value of at least EUR 30,000 excluding VAT. - Lot 4 “Kitchen”: at least one similar kitchenware sales contract with a value of at least EUR 7,000 excluding VAT. If a contract was only partly completed by the tender deadline, only the part and value delivered to and accepted by the client by that time will count. For framework agreements, experience may be demonstrated through completed contracts or orders concluded under the framework agreement. The tender must confirm acceptance of all tender document conditions; conditional tenders are not permitted. The bidder must submit the technical specifications for the relevant lot, a product-based delivery and installation schedule showing delivery and installation periods separately and deadlines to the nearest week, and the applicable price form. Prices must be submitted in euros excluding VAT to two decimal places. Unit prices and the total price must include all costs necessary for proper contract performance, and zero or negative prices are not permitted. Before submitting a tender, the bidder must visit the contract performance site and inspect the explanatory documents on site; the visit must be requested at least two working days in advance. For furniture, the bidder must confirm the use of legally sourced wood and provide product-specific evidence upon delivery, such as an FSC, PEFC, CSA or SFI certificate, or a FLEGT or CITES licence, or equivalent evidence. REACH Candidate List substances above 0.1% by mass must be declared, with safety data sheets, declarations of conformity or a manufacturer’s statement provided upon delivery. Furniture must be capable of being dismantled and repaired without damage using hand tools, and dismantling and repair instructions must be supplied. The warranty must last at least two years, or longer where required by the specification, and spare parts or functionally equivalent elements must remain available for at least two years after delivery.
