Compliance requirements

The bidder must confirm that neither the company nor its representatives or controlling persons have been finally convicted within the relevant five-year period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the unlawful use of child labour or other forms of trafficking in persons. Exclusion may also apply in cases of tax or social security arrears, insolvency, bankruptcy, liquidation, suspended business activities, an agreement with creditors, serious professional misconduct, competition-distorting agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of earlier public contracts, submission of false or withheld information, failure to provide requested documents, or attempts to obtain confidential information or improperly influence the contracting authority. The bidder must also confirm compliance with environmental, social and labour-law obligations and the applicable national exclusion grounds, including unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where an exclusion ground exists, the bidder may, where legally permitted or provided for in the tender documents, submit evidence of remedial measures demonstrating restored reliability. The tenderer must provide the requested details and evidence for any applicable circumstance and confirm the required tax and social security compliance.

Qualification criteria and exclusion grounds

The bidder must submit a compliant tender and complete all required fields in Annex 1, the technical specification. Manufacturer information for the proposed network switches must also be provided. The tender price must follow the structure specified in the worksheet for award criteria and rated indicators. The bidder must have the right to sell the proposed network switches and provide technical support, and must submit documentary proof or a copy of such proof.
