Purchase of explosive particle detection equipment – Repeat tender

The contracting authority will not conclude a framework agreement and will exclude a bidder if any exclusion ground under Section 95(1), points 1–5 of the Estonian Public Procurement Act applies. The bidder must confirm that these grounds do not apply. A foreign bidder must additionally provide a criminal records certificate, or an equivalent document issued by a court or administrative authority in the bidder’s country of establishment, covering the circumstances in points 1–3, and a certificate from the competent authority in that country covering the circumstances in point 4. The bidder must also confirm that it is not subject to a restriction based on its place of establishment or residence that prevents it from submitting a tender under the applicable national rules. The specific restriction is set out in the tender documents.

The bidder must have completed at least one sales contract for explosive particle detection equipment or equivalent equipment during the 36 months preceding the commencement of the procurement, with a value of at least EUR 200,000 excluding VAT. The bidder must provide the contract details, value, signing date and information about the other contracting party, including the customer representative’s contact details and, for public contracts, the procurement reference number. The tender must identify the proposed equipment by name and model and include technical descriptions and public website addresses that allow the contracting authority to independently verify compliance with the technical specification. The tender price must include the equipment, transport to a location designated by the contracting authority, installation, adjustment, user training and technical training required for daily operation. Training must take place at a location designated by the contracting authority, in Estonian or English, before delivery of the equipment. The equipment must have a minimum warranty of 24 months and must have been manufactured in the delivery year, 2026. Any manufacturer-specified testing or calibration accessories must be supplied as part of the equipment at no additional cost. Prices and unit prices must be submitted in the required structure. Zero or negative prices are not accepted, and omitting any unit price will make the tender non-compliant. Conditional tenders are not allowed. Where relevant, equivalence must be explained and supported by evidence. For a joint tender, a power of attorney for the joint bidders must be submitted. Trade secrets must be identified and justified, but the tender price and numerical figures used for evaluation may not be classified as trade secrets.
