Compliance requirements

The bidder and its representatives must not be subject to exclusion grounds relating to participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. This includes final convictions within the last five years or an ongoing exclusion period. The bidder must also have no outstanding tax or social security payment obligations, must not have enabled an unlawfully staying foreign national to work, and must not be subject to an international sanction. The bidder must provide the relevant declarations in the ESPD and, where required, supporting information and evidence. If an exclusion ground applies, evidence of remedial measures restoring reliability may be submitted in cases where this is permitted.

Qualification criteria and exclusion grounds

The bidder’s average total net turnover for the last three financial years, covering 1 January 2023 to 31 December 2025, must be at least EUR 120,000. The turnover information must be provided in the ESPD. As the main contractor, the bidder must appoint a responsible specialist, namely a construction project manager or site manager, holding at least a level 6 road engineer professional qualification or an equivalent qualification. The bidder must provide the person’s name and professional certificate number recorded in the professional register. At the contracting authority’s request, the bidder must submit documents proving the person’s education and professional qualification, together with written consent to participate in the works within the person’s field of competence. The tender must comply with all tender document requirements. The bidder must submit the participation application, the tender price submission and the total price of the works in euros, excluding VAT and unforeseen works. The total amount in Form 2 must be identical to the amount submitted in the main pricing form. The price must cover all works and quantities necessary to achieve the contracting authority’s objective, including labour costs and taxes, construction machinery and equipment, and the required materials.
