Compliance requirements

The bidder must not be subject to mandatory exclusion grounds. Exclusion applies where the bidder, or a member of its administrative, management or supervisory body, an authorised signatory or another person authorised to represent, decide for or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the illegal employment of a foreign national or violating the employment conditions applicable to a foreign national in Estonia, including paying below the statutory wage; unlawful use of child labour or trafficking in human beings. A bidder with outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, is also excluded. The contracting authority may also exclude a bidder that has seriously or persistently breached an earlier public contract, resulting in withdrawal from or termination of the contract, a price reduction, compensation or a contractual penalty. Exclusion is also possible where the bidder has provided false information about compliance with qualification requirements or failed to submit required information or additional documents. The bidder must confirm that none of these exclusion grounds apply. The bidder must also confirm that its registered or permanent establishment is not in the Russian Federation or the Republic of Belarus and that materials, equipment, goods and components used in the works are not produced in or originating from either country. The contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contact details of the client's representative and, for public contracts, the reference numbers. Upon request, the bidder must provide evidence of proper performance, unless the contracting authority can obtain the information from public or private databases without significant expense. No turnover requirement is specified in the documents. The team must include a person with valid switching rights for the switching operations required by the works, registered in Elektrilevi's partner portal before the tender submission deadline. For low-voltage works, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The team must also include a person responsible for the work operation, registered in the partner portal before the deadline, and a person leading the electrical works who has valid A competence and/or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, holds the relevant proof and is registered in the portal. The tender must comply with all tender document requirements; conditional tenders or tenders containing additional conditions are not allowed. The bidder must submit a fully completed price table with all unit-price fields filled in and, where applicable, the information required under the completion instructions for management-system document V178. The names, positions and contact details of the contract signatory and contract-performance contact person must be provided. A power of attorney must be attached if the signatory's authority does not arise from the articles of association. In a joint tender, a power of attorney for the joint tenderers' authorised representative must be submitted. Any trade secrets must be identified and justified, but the tender price and figures characterising works tenders for evaluation purposes may not be designated as trade secrets.
