Compliance requirements
The bidder must confirm that neither the company nor its management, supervisory or representative persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The notice also covers the national exclusion grounds concerning employment of unlawfully residing foreign nationals and violations of international sanctions.
The bidder must not have outstanding tax or social security payment obligations. The bidder must confirm that the offered goods are not subject to international sanctions and are not sourced from sanctioned regions. The bidder must also comply with the applicable EU sanctions restriction and may not use subcontractors or suppliers for more than 10% of the contract value if they fall within the specified Russian-related ownership, residence, incorporation or control categories. Where an exclusion ground exists, evidence of remedial measures may be submitted where legally permitted or provided for in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total net turnover from all business activities must have been at least EUR 150,000 in each of the last three completed financial years. If the information is not available from a public database, the bidder must provide the three latest annual reports or extracts at the contracting authority’s request.
Within the last 60 months, the bidder must have completed at least two cabling work contracts, each worth at least EUR 30,000 excluding VAT. The ESPD must describe the subject matter, value, dates and contracting authority of each contract, including contact details and, where applicable, the procurement reference number. Evidence of proper performance must be provided at the contracting authority’s request.
The bidder must be registered in the relevant business activity under EMTAK 2008 code 43213, “Installation of telecommunications cables and antennas”, and/or code 42221, “Construction of electricity and communications networks”. The bidder must own, be able to acquire or be able to use a calibrated certification device for the contract, capable of checking compliance of the communications works with EN 50173 Classes D and Ea.
Throughout the contract period, the bidder must provide at least three specialists with experience gained during the last three years in performing cabling works similar to the contract subject. A separate CV in the required Appendix 3 format must be submitted for each specialist.
The bidder must be able to supply all required materials, own or rent the necessary tools and equipment, and arrange transport of personnel and materials to the site. The tender must be unconditional, comply with the procurement documents and follow the prescribed price-sheet structure. Details of the person authorised to sign the contract and the contract-performance contact person must be provided; a power of attorney must be attached where applicable. A power of attorney for joint tenderers is required for a joint tender. Where relevant, explanations and evidence of equivalence must be submitted.
