Compliance requirements

The bidder and its representatives must not be subject to exclusion grounds such as convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, trafficking in human beings or unlawful use of child labour. The contracting authority will also check the payment of taxes and social security contributions, bankruptcy or other insolvency, liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious previous contract breaches, and the submission of false information or failure to provide required documents. National exclusion grounds also apply in relation to enabling the employment of unlawfully staying foreign nationals, international sanctions and tax offences. The bidder must provide the declarations required in the ESPD and, where applicable, explanations and evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The machine-readable notice did not specify numerical requirements for financial capacity, previous experience, staffing or other separate selection criteria. However, the bidder must submit a compliant tender and complete Annex 3, the product specification and pricing form; the fields for the medicine name, manufacturer and unit price excluding VAT must be completed. The proposed goods must meet the requirements set out in Annex 1, the technical description. The tender price must follow the prescribed structure, and conditional tenders are not permitted. Where applicable, equivalence must be explained and supported by evidence. The tender must include the details of the contract signatory and contract contact person; if an authorised representative signs the contract, a power of attorney from the bidder’s legal representative must be provided. For a joint tender, a power of attorney for the joint tenderers must be included. The bidder must confirm that it will not use, for more than 10% of the contract value, sanctioned Russian persons or entities, or suppliers or subcontractors owned or controlled by them, and that the proposed goods are not subject to international sanctions and do not originate from a sanctioned region.
