Compliance requirements
The bidder must confirm that neither the bidder nor its management or supervisory board members, procurists or other authorised representatives have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Such persons must also not have been convicted of unlawfully enabling an illegally residing foreign national to work or violating the conditions for a foreign national’s employment, including paying below the legally required wage, or of illegal use of child labour or human trafficking.
The bidder must have no outstanding state tax, payment or environmental charge debt, or tax or social security debt under the law of its country of establishment. The contracting authority may also exclude a bidder for materially or repeatedly breaching a previous public contract, or for providing false information about compliance with selection criteria or failing to submit required information or documents. The bidder must confirm that none of these mandatory or discretionary exclusion grounds apply.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, details of the other contracting parties, the client representative’s telephone and email contacts, and procurement reference numbers where applicable. At the contracting authority’s request, evidence of proper performance must be submitted.
The person managing the electrical works must hold a valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act, possess the relevant evidence when submitting the tender, and be registered in the EPP environment before tenders are opened. The bidder must also have a person with valid rights appointed as the person responsible for the work operation, known as the C-person, who must likewise be registered in the EPP environment before tenders are opened.
The tender must comply with all procurement document requirements; additional conditions and conditional tenders are not permitted. The bidder must submit a fully completed price table, the name, position and contact details of the contract signatory, and the details of the contact person for contract performance. A power of attorney must be added if the signatory’s authority does not arise from the articles of association. Standard payment periods are 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts between EUR 60,000 and EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the factoring programme results in a 95-calendar-day payment period. Any trade secret must be identified and justified; the tender price and evaluable numerical indicators may not be classified as trade secrets. Materials, equipment and goods originating from Russia or Belarus may not be used, and the contracting authority may request certificates of origin.
