Compliance requirements

The bidder must confirm that neither the bidder nor its management, supervisory or representative persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The relevant information and, where applicable, evidence of remedial measures must be provided in the European Single Procurement Document. The bidder must not have outstanding tax or social security payment obligations. The bidder must also disclose any significant or repeated breach of a previous public contract that led to early termination, damages, a price reduction or a contractual penalty. Further exclusion grounds concern enabling the illegal employment of foreign nationals, being subject to international sanctions and any restriction on participation based on the bidder’s place of establishment or residence. The bidder must identify persons authorised to represent, control or make decisions for the company who are not visible in the relevant commercial register, or confirm that no such persons exist. For a joint tender, each joint tenderer must submit a separate procurement passport.

Qualification criteria and exclusion grounds

The bidder’s net turnover in the latest financial year completed by the start of the procurement must be at least EUR 20,000. Joint tenderers may aggregate their turnover. The turnover must be stated in the procurement passport and, upon request, supported by an extract from the annual report or other evidence, unless the information is publicly available from the Estonian register. If the bidder relies on another entity’s turnover, it must submit that entity’s procurement passport, consent, confirmation that the necessary financial resources will be made available, and confirmation of joint and several liability. Within the 36 months preceding the start of the procurement, the bidder must have properly completed at least one contract for designing the construction of a publicly used road, with a value of at least EUR 20,000 excluding VAT. The bidder must provide the contract description, value, performance period, its scope of responsibility and the client’s contact details. Upon request, a client confirmation must be provided showing the contract completion deadline and the length of the bridge, viaduct, tunnel or wildlife crossing designed under the contract. If another entity’s experience is relied upon, that entity must participate directly in the performance of the relevant part of the contract and provide the required consent. For a joint tender, separate procurement passports for all joint tenderers and a signed power of attorney appointing the authorised representative must be submitted.
