Compliance requirements
The bidder must confirm that neither the bidder nor members of its representative, management or supervisory bodies have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful use of child labour or human trafficking. The check also covers persons authorised to represent, control or make decisions on behalf of the bidder. The bidder must not have outstanding tax or social security payment debts and must not have enabled a foreign national residing unlawfully to work. The bidder must also confirm that entering into the contract would not breach international or Estonian sanctions. Where relevant, the bidder must provide the required explanations and evidence; remedial measures may be described where permitted.
Qualification criteria and exclusion grounds
The machine-readable procurement passport does not specify concrete requirements concerning turnover, previous experience, personnel, registration or professional certificates; these must be checked in the tender documents. The compliance requirements are nevertheless specified: the tender must be unconditional and comply with all procurement documents. The tender price must be submitted in the required structure. In a joint tender, an authorisation from the consortium members must be included. The bidder must identify and justify any trade secrets, but may not classify the tender price or other numerical figures relevant to evaluation as trade secrets. Where necessary, an equivalent solution must be explained and supported with evidence of compliance. The bidder must also confirm that it will not use a subcontractor who would have to be replaced because of an exclusion ground.
