Compliance requirements
The bidder must confirm that neither the bidder, its management or supervisory body members, procurators, nor persons authorised to represent or control the company have been convicted of offences involving participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing. There must also be no conviction for enabling the employment of an illegally residing foreign national, breaching the employment conditions applicable to a foreign national in Estonia, illegal use of child labour or human trafficking. The bidder must have no outstanding state taxes, charges or environmental fees, nor tax or social security payment debts under the law of its country of establishment, and awarding the contract must not breach international or Estonian sanctions. The bidder must confirm that none of these exclusion grounds apply. Any circumstances that may indicate a conflict of interest or a distortion of competition must be disclosed to the contracting authority; if the relevant confirmation is negative, an explanation must be submitted in free form.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment where registration is legally required and must provide evidence of registration. Bidders established in Estonia do not have to submit a copy of the Estonian commercial register document.
The bidder and/or its subcontractor must have completed, during the 60 months preceding the commencement of the procurement, at least one contract involving the design of water and/or fire-extinguishing systems and at least one contract involving the installation of water and/or fire-extinguishing systems. Form 2, the list of contracts, must be submitted with the name, brief description, performance period and other contracting party for each contract. If the bidder relies on subcontractor references, the subcontractor must be disclosed in the tender so that the contracting authority can verify its exclusion grounds.
The bidder and/or its subcontractor must have the following qualified responsible specialists for performing the works: a security systems design specialist with at least level 6 qualification and competence in designing water and foam fire-extinguishing systems; a responsible security systems specialist with at least level 5 qualification and competence in installing and maintaining water and foam extinguishing systems; and a civil engineer holding the required level and specialisation as a construction manager or construction works manager, or a water supply and sewerage engineer qualification at level 6, 7 or 8. Equivalent or higher qualifications are permitted. Form 3, the list of responsible specialists, and copies of documents proving their qualifications and competence must be submitted. A foreign bidder must provide qualification evidence issued under the law of its country of establishment and confirm that confirmation from the Estonian Consumer Protection and Technical Regulatory Authority will be submitted within one month after signing the contract.
The tender must comply with all tender document requirements, and conditional tenders are not permitted. The price must be submitted using the specified structure, with all required fields completed in Form 1; rows may not be deleted from the table. The bidder must provide the brand and type specifications and/or supply-volume description of the pressure piping, check valves, sluice valves and other equipment proposed for installation. Any equivalent solution must be clearly explained and supported by evidence where necessary. In a joint tender, a power of attorney for the joint bidders must be included. Trade secrets must be identified and justified, but the tender price and figures characterising goods or construction works for evaluation purposes may not be classified as trade secrets.
