Compliance requirements

The bidder must confirm using the HD Annex 5 form that neither the bidder nor its management, administrative or supervisory body members, authorised representatives or controlling persons have been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or human trafficking-related acts. The bidder must have no outstanding tax, payment or social-security contribution debts, and awarding the contract must not breach an international or Government of Estonia sanction. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract, false information, or failure to submit required information or documents. In a joint tender, each joint bidder must provide the relevant confirmations using HD Annex 5.

Qualification criteria and exclusion grounds

• Where required by the law of its country of establishment, the bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a country that has joined the WTO Government Procurement Agreement. Upon request, a valid registration certificate must be provided; an Estonia-registered bidder generally does not need to provide a copy where the information is publicly available. • The bidder’s net turnover must have been at least EUR 1,600,000 excluding VAT in each year from 2023 to 2025. The turnover data must be submitted using HD Annex 5 and, upon request, supported by an extract from the annual report or another suitable document. • During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least one building-construction contract. The building covered by the works must have a closed net floor area of at least 500 m²; renovation and reconstruction works may also qualify. The works must have been accepted and completed without serious breaches. Contract details must be provided using HD Annex 5 and, upon request, supported by a confirmation from the client. • If relying on another entity’s economic, financial, technical or professional capacity, the bidder must provide information about that entity in HD Annex 5 and the entity’s confirmations in HD Annex 5.1. • The tender must include the participation application in HD Annex 2. It must comply with the tender documents and be unconditional; any equivalent solution must be explained and supported with evidence. • The tender price must be submitted in euros in the required structure and using the price breakdown in HD Annex 7. The price form may not be changed or supplemented with comments. In the event of a discrepancy, the VAT-exclusive total shown in the price form prevails; where the unit price and total differ, the unit price prevails. • For a joint tender, the bidders must appoint an authorised representative, accept joint and several liability, and include the HD Annex 4 power of attorney signed by all joint bidders. • For furniture, only legally sourced wood may be used, and proof of origin, such as an FSC certificate or an FLEGT or CITES licence, must be provided upon delivery. REACH candidate substances exceeding 0.1% by mass must be declared and evidenced upon delivery. • Furniture must be dismantlable and repairable with hand tools by an untrained person, and instructions enabling non-damaging dismantling and repair must be supplied with the furniture. The furniture must have a warranty of at least two years, and spare parts or functionally equivalent components must be available for at least two years after delivery.
