Compliance requirements

The bidder must not be subject to exclusion grounds such as participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or the unlawful use of child labour or human trafficking. The bidder must also have no outstanding taxes or social security contributions and must not be bankrupt, in liquidation, subject to insolvency proceedings or in a comparable situation. Other possible exclusion grounds include breaches of environmental, social or labour law, serious professional misconduct, anti-competitive agreements, conflicts of interest, an unjustified advantage resulting from involvement in preparing the procurement, a material breach of a previous public contract, or the submission of false information or failure to provide required documents. National grounds also cover enabling an unlawfully resident foreign national to work, breaches of international or national sanctions, conviction for tax offences, and lack of legal entitlement to participate in the procurement. The bidder must confirm that neither it nor its representatives are subject to these grounds. Where an exclusion ground applies, evidence of remedial measures restoring reliability may be submitted in certain circumstances. For taxes and social security contributions, the bidder must, where necessary, prove that the obligations have been fulfilled or that a binding payment agreement has been concluded.

Qualification criteria and exclusion grounds

The bidder must have completed at least two development contracts or projects during the 36 months preceding the start of the procurement, concerning the development and implementation of a data-centred information system. Each contract must have an individual value of at least EUR 150,000 excluding VAT and must be substantively comparable to the subject matter of the tender. A data-centred information system must involve the management and processing of structured data, support data queries such as searching or filtering, and use a layered architecture consisting of at least a data layer, business logic and a user interface. The bidder must provide the references in the ESPD as a list of contracts with their value, client and contact person details, performance period and a description of the work. The description must explain the system’s purpose, the bidder’s role, implementation of the requirements and the interaction between the system layers. For a public contract, the procurement reference number must also be provided. As a rule, the work must have been delivered and accepted by the client; for phased performance, accepted work worth at least EUR 150,000 excluding VAT is sufficient. The framework agreement itself cannot be used as a reference, but completed contracts concluded under it may qualify. The bidder must form a team whose members participate personally in contract performance. Each skill area listed in the form “310813_Vorm_Oskusvaldkonnad.docx” must be covered by at least one team member with at least two qualifying projects in that area. One team member may cover up to three skill areas. The form also confirms the team members’ consent to personal-data processing and participation in the tender. The tender must include a sample assignment uploaded as a ZIP file containing the complete source code and a README with run instructions, with a maximum size of 100 MB, together with an explanatory note of up to three pages. External repository or website links are not accepted as the sample assignment, and only the version submitted by the deadline will be assessed. The tender must be unconditional and comply with the tender documents; the price must follow the required structure. The bidder must confirm compliance with environmental requirements, provide a power of attorney for joint bidders where applicable, and identify and justify any trade secrets. During contract performance, subcontractors and suppliers may be used only from Estonia, European Union or European Economic Area countries, or countries participating in the World Trade Organization Government Procurement Agreement. In addition, Russian-related subcontractors and suppliers may not account for more than 10% of the contract value.
