Compliance requirements

The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been opened against it, or if its business activity has been suspended, or if it has outstanding tax, fee or environmental charges debts, or tax or social security contribution debts. The absence of debts may need to be proven with a Tax and Customs Board certificate or another equivalent document. The bidder must also not be subject to the exclusion grounds listed in points 1–3 and 5 of Section 95(1) of the Public Procurement Act. The bidder must confirm that its average employee wage has not been below 70% of the average wage in the relevant sector and that it is not a related person to the technical consultant advising the apartment building reconstruction. If the required confirmations or evidence are not submitted, the bidder may be excluded.

Qualification criteria and exclusion grounds

The bidder must be registered in the Economic Activities Register for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also be registered for electrical works, including installation of electrical installations. The registration requirement does not apply to foreign bidders; in that case, equivalent proof of competence must be provided. The bidder's net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated value of the contract, excluding VAT. The exact amount must be entered in euros. The bidder must be able to provide a construction-period security equal to 5% of the contract value excluding VAT, issued on first demand by a credit institution, financial institution or insurance company. If the contract is signed before the security is provided, it must be submitted within 10 calendar days after signing. Joint bidders may satisfy this requirement together. Within the last 60 months before the start of the procurement procedure, the bidder must have completed at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means construction of a building, extension of a building, or full-scale reconstruction as the main contractor, and it must have included at least one of the following: construction or reconstruction of load-bearing structures and external envelope, construction or reconstruction of a heat-recovery forced ventilation system, or construction or reconstruction of a new heating system. The bidder must provide the project name, building details, period, value, and information showing that the project met these conditions. The bidder's team must include a project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, and, if electrical works are included, a person with at least B-class competence certificate or an electrical engineer qualification in consumer electrical installations, level 6. For each role, the bidder must provide proof of the required qualification or equivalent competence. If the bidder relies on the capacities of another person, signed confirmations from those persons must be submitted.
