Compliance requirements

The bidder must not be subject to exclusion grounds related to final criminal convictions of the company, its management, supervisory bodies, authorised representatives or controlling persons, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. The bidder must also comply with the applicable rules on taxes and social security contributions. Exclusion grounds also cover breaches of environmental, social and labour-law obligations, bankruptcy, insolvency or liquidation proceedings, agreements with creditors, administration of assets by a liquidator or court, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated failures under previous public contracts, and false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the contracting authority. Where permitted, evidence of remedial measures may be submitted. Participation is not permitted for companies domiciled or established in the Russian Federation or the Republic of Belarus. The bidder must provide the names and personal identification codes of authorised persons who are not visible to the contracting authority through the relevant register, or confirm that no such persons exist. The bidder must also confirm compliance with national exclusion grounds, including sanctions, unlawful employment of foreign nationals, relevant tax offences, local tax debts where applicable, and statutory restrictions on participation.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least one contract during the 36 months preceding the start of the procurement involving the preparation of a master design for a stormwater system, including stormwater drainage, ditches or other nature-based stormwater solutions. The ESPD must include the contract description, signature and completion dates, value, and the contracting party’s name and contact details. At the contracting authority’s request, additional explanations, information or documents must be provided within up to 5 working days where the information is not readily available in public databases. The project manager responsible for managing the design work must hold a diploma-level water supply and sewerage engineer qualification, or an equivalent qualification at least at Estonian or European qualification framework level 7, excluding an initial qualification. The specialisation must be external water supply and sewerage, with competence in design management. The project manager’s details must be provided, and qualification evidence must be submitted on request, including where the project manager is engaged as a subcontractor. The tender must comply with the procurement documents and must be unconditional. Prices must be submitted in euros excluding VAT, to two decimal places, and in the structure of the price form in Annex 2. Every line must be completed; the form may not be amended and additional conditions may not be added. The price must include all costs necessary for proper contract performance. Zero or negative unit prices are prohibited. The bidder must provide a team with sufficient capacity and competence, including specialists for special disciplines, and submit the required confirmations. Where equivalence is relied upon, an explanation and supporting evidence must be provided. For a joint tender, a power of attorney from the joint tenderers must be included.
