The bidder must confirm the standard exclusion grounds in the ESPD: no final convictions for participation in a criminal organisation, corruption, fraud and the other mandatory exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may provide evidence of self-cleaning where allowed. The notice also requires confirmation that the bidder and its representatives are not subject to the relevant sanctions-related restrictions.

The bidder must have the manufacturer’s right in the territory of Estonia to sell the contract subject and the right to provide services for it in line with the technical specification. To prove this, the bidder must submit a copy of a document or a link to the manufacturer’s or partner’s website. If the representation right is provided through a cooperation partner, the bidder must submit both the manufacturer’s confirmation or website link and the cooperation partner’s confirmation or website link showing cooperation with the bidder. The ESPD also requires confirmation that the tender complies with the tender documents and, where relevant, that equivalence has been explained and supporting evidence attached.
