Placement of liability and legal expenses insurance policies

Summary

The procurement covers insurance contracts in two lots: liability risks and legal expenses insurance. The contracts run for five years, from 1 January 2027 to 31 December 2031. Either party may terminate annually on the main renewal date of 1 January, subject to six months’ notice. The legal expenses policy must cover legal advice and the resolution and defence of disputes, both out of court and in court, including necessary lawyer, expert and legal-proceeding costs. The insured may choose its own adviser. The overall limit is EUR 50,000 per dispute, the intervention threshold is EUR 200, and there is no deductible. The bid must place the entire risk, representing 100% of the insurance or co-insurance cover, and state the contribution base, premium rates and annual premiums both excluding and including tax. Bidders must provide information on their financial and technical capacity, the required declarations, and completed questionnaires on contract performance conditions and environmental criteria. Insurers need the relevant authorisation; intermediaries are subject to additional mandate and insurance or ORIAS evidence requirements.
