The notice includes a national exclusion ground concerning participation restrictions based on the bidder’s place of establishment or residence. The bidder must confirm that it is not subject to a contracting authority restriction on submitting a tender or request to participate and, where applicable, provide the relevant electronic source, URL, code and issuing authority. The contracting authority may reject a tender if the resulting contract would be void under applicable sanctions legislation.

The procurement passport specifies no separate qualification or suitability criteria. The bidder must submit a tender that complies with the procurement documents and is unconditional, and must provide the tender price in the structure prescribed by the contracting authority. Where necessary, the bidder must include an explanation of equivalence and supporting evidence. For a joint tender, a power of attorney for the joint tenderers must be submitted. The bidder must identify and justify any trade secrets in the tender, or state that the tender contains no trade secrets. The tender price and other figures characterising the tender against the award criteria may not be classified as trade secrets.
