Compliance requirements
The contracting authority will exclude a bidder if a ground for exclusion set out in section 95(1) of the Public Procurement Act applies. The contracting authority may also exclude a bidder if a ground under section 95(4) applies. When submitting the tender, the bidder must confirm that no such grounds exist. Before signing the contract, the contracting authority will verify, on the basis of evidence, at least the absence of the exclusion grounds referred to in section 95(1). In addition, the bidder must confirm that subcontractors and suppliers representing more than 10% of the contract value are not citizens or residents of the Russian Federation, entities established in the Russian Federation, or entities more than 50% owned by, represented by, or acting on the instructions of such persons or entities. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas of the world.
Qualification criteria and exclusion grounds
The bidder, including each joint bidder in a joint tender, must hold a valid operating licence at the place of service provision for outpatient general surgery services on the date the tender is submitted. The licence must cover the locations where the bidder will provide the service. If the bidder also wants to provide day surgery services in general surgery, the bidder, including each joint bidder, must also hold a valid operating licence for day surgery in general surgery and anaesthesiology at the place of service provision. The bidder must enter the licence number(s) in the tender form and confirm that the service will be provided in the premises on which the licence was issued. The bidder's 2025 healthcare services net turnover must be at least EUR 96,789; for day surgery services in general surgery, an additional EUR 27,353 is required. The required turnover is calculated per one doctor working full-time in outpatient care and increases proportionally with the number and workload of doctors stated in the tender. The bidder must have provided outpatient general surgery services at least 50 times during the 12 months before the date of the decision to announce the tender. If day surgery services in general surgery are also offered, the bidder must have provided such services at least 12 times during the same 12-month period. If those day surgery services were provided on a paid basis, copies of the epikrisis documents from that period must be attached with patient personal data masked. For e-consultation, the bidder must either have provided e-consultations in the offered specialty during the 12 calendar months before the month of the decision to announce the tender, or be ready to provide e-consultation through the health information system by the tender deadline, where this is required by law for the specialty. The bidder must confirm this in the procurement register. The machine-readable notice did not include any more precise qualification requirements; they must be checked in the tender documents.
