Compliance requirements

The bidder must confirm that neither the company nor its management, supervisory body members, authorised representatives or other persons able to represent or control it have been finally convicted within the relevant five-year period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also confirm compliance with tax and social security payment obligations. Further exclusion grounds cover agreements with creditors, bankruptcy or insolvency proceedings, liquidation, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of previous public contracts, submission of false or incomplete information, failure to provide requested documents, and breaches of environmental, social or labour-law obligations. National grounds also concern unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where an exclusion ground exists, the bidder may, where legally permitted, provide evidence of remedial measures demonstrating restored reliability. The bidder must provide the required declarations and supporting information in the procurement passport.

Qualification criteria and exclusion grounds

The bidder must submit the required European Single Procurement Document and confirm that no exclusion grounds apply. The machine-readable procurement passport does not specify a particular turnover threshold, financial-capacity requirement, or required number or value of previous contracts. The bidder must provide a technical description of the proposed equipment and all accessories, together with manufacturer-issued technical documentation in Estonian or English, such as operating and maintenance instructions, certificates and other documents proving compliance. The participation application, tender form and pricing form must be completed, and the tender must follow the prescribed pricing structure. Conditional tenders are not permitted. The bidder must appoint two specialists with at least two years of experience in installing presentation equipment during the last ten years. CVs for both specialists must be submitted to demonstrate compliance. The bidder must organise reuse and recycling services for equipment taken out of service and describe collection, confidential handling and erasure of data media, and dismantling for recycling or disposal. If the bidder is not a member of a producer responsibility organisation, it must submit either evidence concerning an authorised waste-management partner or an environmental permit for the waste sector. The tender must declare REACH Candidate List substances present above 0.1% by mass, or provide evidence that they are absent from the product and specified accessories. The product must be covered by a warranty of at least three years, including repairs, a replacement product during warranty repair and battery defects.
